TERMS AND CONDITIONS OF THE MIMII ONLINE STORE
Effective date: 24 July 2026
These Terms and Conditions set out the rules for using the Mimii online store available at https://mimii.de/en, placing orders, concluding sales contracts, delivery, payment, withdrawal from a contract and submitting complaints.
1. Seller and contact details
The online store is operated by:

The Seller may be contacted in English or Polish.
The postal address stated above is also the address for correspondence, complaints and returns, unless the Seller provides the Customer with a different return address in writing.
2. Definitions
For the purposes of these Terms and Conditions:
Seller means MIMII SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ.
Store means the Mimii online store available at https://mimii.de/en.
Customer means any natural person, legal person or organisational unit placing an Order in the Store.
Consumer means a natural person concluding a contract with the Seller for purposes outside their trade, business, craft or profession. Where required by Polish law, certain consumer protections also apply to an eligible sole trader concluding a contract directly related to their business but not of a professional nature for that person.
Product means a movable item offered for sale in the Store.
Order means the Customer’s declaration of intent to purchase one or more Products through the Store.
Sales Contract means a distance sales contract concluded between the Customer and the Seller through the Store.
Business Day means a day from Monday to Friday, excluding public holidays in Poland.
Account means the optional individual customer account available in the Store.
3. General rules and technical requirements
The Store sells products for children, including ball pits, ball pit balls, foam play sets, modular play sofas, play mats, poufs and accessories.
To use the Store, the Customer needs:
a device with internet access;
an up-to-date web browser supporting JavaScript and cookies;
an active email address.
The Customer must provide accurate, complete and current information when placing an Order.
The Customer may not use the Store unlawfully, interfere with its operation or provide unlawful content.
Creating an Account is not required to place an Order. The Customer may purchase as a guest.
The Terms and Conditions are available free of charge in a form that allows them to be saved and reproduced.
4. Products and product information
Product descriptions, photographs, dimensions, materials, available variants and prices are displayed on the relevant Product page.
The Seller makes reasonable efforts to ensure that all descriptions and photographs are accurate. Colours may appear slightly different depending on screen settings and lighting. This does not limit the Customer’s statutory rights if the Product is not in conformity with the Sales Contract.
Products should be used in accordance with their intended purpose, age recommendations, safety information and care instructions.
Where adult supervision is recommended on the Product page or instructions, the Product should only be used under appropriate adult supervision.
Information concerning certificates or compliance with standards applies only where expressly stated for the relevant Product.
Product availability may change. If a Product becomes unavailable after an Order has been placed, the Seller will inform the Customer promptly and refund any payment received for the unavailable Product.
5. Placing an Order and concluding the Sales Contract
To place an Order, the Customer must:
select the Product and available variants;
add the Product to the cart;
provide the information required for delivery and billing;
select an available delivery and payment method;
review the Order;
accept these Terms and Conditions;
confirm the Order using the button indicating an obligation to pay.
Before confirming the Order, the Customer may review and correct the entered information.
After the Order is placed, the Customer receives an electronic confirmation at the email address provided.
The Sales Contract is concluded when the Seller confirms acceptance of the Order. An automatically generated message confirming receipt of the Order may also constitute acceptance if its wording clearly confirms the sale.
The contract is concluded in English.
The Seller provides confirmation of the Sales Contract and these Terms and Conditions on a durable medium, normally by email.
The Customer may request cancellation before dispatch. The Seller will make reasonable efforts to stop fulfilment. If the Order has already been dispatched, a Consumer may exercise the right of withdrawal described below.
6. Prices and payments
Product prices are shown in the currency applicable to the Customer’s selected market or delivery country.
Prices include VAT where applicable. Delivery charges and any other mandatory costs are displayed before the Customer confirms the Order.
The total amount payable is shown at checkout before the Order is submitted.
Where required by law, a price reduction is accompanied by information about the lowest price applied during the legally required reference period.
The Customer may use the payment methods displayed at checkout. Depending on the market, these may include payment cards, PayPal, Klarna, Shop Pay, Apple Pay, Google Pay or other available methods.
Payments may be processed by external payment service providers under their own terms and privacy information.
If advance payment is selected, the Seller begins processing the Order after payment has been successfully confirmed.
7. Dispatch and delivery
Delivery is available to the countries that can be selected in the country or region selector and at checkout when the Order is placed.
Available carriers, delivery methods and delivery charges are displayed at checkout.
Orders are dispatched within 48 hours after payment confirmation.
The estimated delivery time is 3–5 Business Days after dispatch.
Delivery times may be affected by weekends, public holidays, remote delivery locations, unusually high order volumes or circumstances beyond the carrier’s reasonable control. If a material delay occurs, the Seller will inform the Customer where possible.
If the Seller does not deliver within the agreed period, the Consumer may request delivery within an additional period appropriate to the circumstances. If the Seller still fails to deliver within that additional period, the Consumer may terminate the Sales Contract, subject to mandatory law.
The risk of accidental loss of or damage to the Product passes to the Consumer when the Consumer or a third party designated by the Consumer, other than the carrier, takes physical possession of the Product.
The Customer should inspect the parcel upon delivery. Visible transport damage should be reported to the Seller as soon as possible. Photographs of the parcel and Product may help the Seller process the case, but failure to prepare a carrier’s damage report or provide photographs does not remove the Consumer’s statutory rights.
Large Orders may be delivered in more than one parcel. The Seller will not charge an additional delivery fee after the Sales Contract has been concluded unless the Customer expressly agrees to it.
8. Customer Account and electronic services
The Seller provides the following electronic services free of charge:
access to and use of the Store;
creation and maintenance of an Account;
contact forms;
newsletter subscription, where available.
The Customer may delete their Account or unsubscribe from the newsletter at any time without giving a reason.
Newsletter consent is voluntary and may be withdrawn at any time using the unsubscribe link included in the message or by contacting the Seller.
Complaints concerning the operation of the Store or electronic services may be sent to info@mimii.pl. The Seller will respond within 14 days.
9. Consumer’s right of withdrawal
A Consumer who concludes a Sales Contract at a distance may withdraw from it within 14 days without giving any reason, subject to the statutory exceptions described below.
The withdrawal period expires 14 days after the day on which:
the Consumer or a third party designated by the Consumer, other than the carrier, takes possession of the Product; or
in the case of several Products delivered separately, the Consumer takes possession of the last Product, batch or piece.
To exercise the right of withdrawal, the Consumer must inform the Seller of the decision by an unequivocal statement sent:
by email to info@mimii.pl; or
by post to MIMII SP. Z O.O., ul. 30 Stycznia 38B, 83-110 Tczew, Poland.
The Consumer may use the model withdrawal form attached to these Terms and Conditions, but this is not mandatory.
It is sufficient for the Consumer to send the withdrawal statement before the 14-day period expires.
The Consumer must return the Product without undue delay and no later than 14 days after informing the Seller of the withdrawal. The deadline is met if the Product is sent before the 14-day return period expires.
The Consumer bears the direct cost of returning a Product following withdrawal, unless the Seller has agreed to bear that cost or failed to provide information that the Consumer must bear it.
The returned Product should be securely packaged to prevent damage in transit.
The Seller will refund all payments received from the Consumer, including the cost of the least expensive standard delivery method offered for the Order.
The Seller is not required to refund additional delivery costs resulting from the Consumer’s choice of a delivery method more expensive than the least expensive standard method offered.
The refund will be made without undue delay and no later than 14 days after the Seller is informed of the withdrawal.
The Seller may withhold the refund until the returned Product is received or the Consumer provides evidence of having sent it back, whichever occurs first.
The refund will be made using the same payment method used for the original transaction unless the Consumer expressly agrees to another method that does not involve additional costs.
The Consumer is responsible only for any diminished value of the Product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.
Opening the transport or vacuum packaging does not, by itself, exclude the right of withdrawal. However, use during play, washing, staining, damaging, contaminating or otherwise handling the Product beyond what is reasonably necessary to inspect it may reduce its value.
10. Standard variants, configurator and individually made Products
The Store’s configurator allows the Customer to select standard variants from the Seller’s current offer, such as size, fabric, colour, set composition, number of balls and ball colours.
Selecting standard variants available in the Store does not, by itself, make the Product an individually personalised Product and does not exclude the Consumer’s 14-day right of withdrawal.
The right of withdrawal may be excluded only for a Product that is genuinely:
made to the Consumer’s individual, non-standard specifications; or
clearly personalised to meet the Consumer’s individual needs,where the Consumer has been clearly informed of this before placing the Order.
If an Order concerns such an individually made Product, the relevant Product page or individual offer will clearly state before purchase that the statutory right of withdrawal does not apply.
11. Statutory complaints and conformity of Products
The Seller is legally responsible to Consumers for a Product’s lack of conformity with the Sales Contract.
A Product is in conformity with the Sales Contract if, in particular, its description, type, quantity, quality, completeness, functionality, durability and safety correspond to the contract and to what a Consumer may reasonably expect.
The Seller is liable for a lack of conformity that exists at the time of delivery and is revealed within two years from delivery, unless a longer period applies under mandatory law or has been expressly offered by the Seller.
If a Product is not in conformity with the Sales Contract, the Consumer may request repair or replacement.
The Seller may repair instead of replace, or replace instead of repair, if the Consumer’s chosen remedy is impossible or would impose disproportionate costs, in accordance with applicable law.
Repair or replacement will be carried out within a reasonable time, free of charge and without significant inconvenience to the Consumer. The Seller bears the necessary costs, including transport, labour and materials.
The Consumer may request an appropriate price reduction or terminate the Sales Contract in the circumstances provided by mandatory law, including where:
repair or replacement is impossible or disproportionate;
the Seller has failed to bring the Product into conformity within a reasonable time;
the lack of conformity remains despite an attempted repair or replacement;
the lack of conformity is sufficiently serious; or
it is clear that the Seller will not bring the Product into conformity within a reasonable time or without significant inconvenience.
The Consumer may not terminate the Sales Contract if the lack of conformity is minor, unless mandatory law provides otherwise.
Complaints may be submitted:
by email to info@mimii.pl; or
by post to MIMII SP. Z O.O., ul. 30 Stycznia 38B, 83-110 Tczew, Poland.
The complaint should, where possible, include the Order number, a description of the issue, the date it was noticed and the requested remedy. Photographs may assist in examining the complaint but are not mandatory where the claim can be assessed without them.
Proof of purchase may be provided in any reliable form. A paper receipt is not the only acceptable proof of purchase.
The Seller will respond to a Consumer complaint within 14 days of receipt. Where Polish law applies, failure to respond within that period has the consequences provided by mandatory law.
The Consumer makes the Product available to the Seller for repair or replacement. The Seller collects the Product at its own cost where required by law.
Statutory rights concerning lack of conformity do not cover damage caused after delivery by misuse, failure to follow care or safety instructions, accidental damage or normal wear and tear, unless the damage results from a lack of conformity existing at delivery.
Any commercial warranty is voluntary and applies only if provided in a separate warranty statement. A commercial warranty does not limit statutory consumer rights.
12. Personal data
The Seller is the controller of personal data processed in connection with use of the Store and performance of Orders.

The use of cookies and similar technologies is described in the Privacy Policy and the Store’s cookie settings.
13. Out-of-court dispute resolution
The Seller aims to resolve complaints directly and encourages the Consumer to contact the Seller first at info@mimii.pl.
The Seller has not committed to using any particular alternative dispute resolution entity, unless participation is required by mandatory law in a particular case.
A Consumer may seek information about available out-of-court complaint and redress procedures through competent consumer authorities or the European Commission’s Consumer Redress portal:

This section does not limit the Consumer’s right to bring proceedings before a competent court.
14. Governing law and final provisions
Sales Contracts concluded through the Store are governed by Polish law.
If the Customer is a Consumer habitually resident in another country, the choice of Polish law does not deprive that Consumer of the protection granted by mandatory provisions of the law of the country in which the Consumer has their habitual residence, where those provisions apply.
Any disputes will be resolved by the court having jurisdiction under applicable law. Nothing in these Terms and Conditions limits a Consumer’s mandatory right to bring a claim before a competent court.
The Privacy Policy, Shipping Policy and Refund Policy available in the Store supplement these Terms and Conditions. In the event of a conflict, mandatory law and these Terms and Conditions prevail, unless a separate policy gives the Consumer more favourable rights.
If any provision of these Terms and Conditions is held invalid or unenforceable, the remaining provisions remain in effect.
The version of the Terms and Conditions accepted when the Order was placed applies to that Sales Contract.
The Seller may amend these Terms and Conditions for future Orders, including due to changes in law, payment or delivery methods, Store functionality or business information. Amendments do not reduce rights acquired under Sales Contracts concluded before the effective date of the amended version.
